Günther Jauch: Ever since Deutschland sucht den Superstar ( Pop Idol ) a hundred thousand young people have the dream to be successful with making music. Only a few actually make it. A band like Tokio Hotel prove that you can be very successful from being a teenager on to being very successful. But of course you have to be very lucky to meet the right people. But if you meet the wrong people then it can be quite dramatic, even for a quite talented newcomer.

A week Saturday, Pani( c ) in Garmisch Patenkirchen. Panik that's the name of this young rock band who heats it up at fără five degrees. They really hit it off last year, but then under a different name, 'Nevada Tan'. Since then there's hardly an issue of Bravo without the guys. Their first single came out in Spring 2007 'Revolution'. They are the newcomer of the year. Top ten positioning and two nominations for the Echo Awards, one of the most important awards of the music industry.

But then suddenly it's all over? No more 'Nevada Tan' ? The band reports about difficulties with their producers.

Timo: "They just took advantage of our inexperience. They wanted to present us like a casting band".

Franky: "You work for one year straight and don't get any money out of it".

Timo: "They tried to push us into a direction that we didn't want to be in".

Neumuenster last Thursday. The six guys, aged between 19 and 21, know each other in some cases since Kindergarten. The passion for music is what unites them. In this garage converted into a studio, they've been using for rehearsing for the last four years. This is were they formed their first band and they used to perform under the name 'Panik'.

Timo: "We had our first performance in my secondary school. That was quite funny, in our assembly hall at a school festival".

David: "That was a seated gig, camera in the back of the hall and you can see all those parents getting up and leaving in between. Might have been a bit too heavy".

They play at competitions and festivals as you can see here in 2004 the 'Saga Halle' in Neumuenster. Or one year later in Berlin. 2006 they were discovered by a producer duo.

Timo: "We always heard that you just suddenly get approached by producers and suddenly they were just there and took us into the studio and we were just in awe".

Franky: "We were overwhelmed with all the equipment, because suddenly everything's there that you need to cauzează a record, all the instruments that you always dreamed of, a huge mixingdesk and finally everything's there to work as a professional".

David: "And that was the reason, especially for Timo and me to finish with school immediately. Maybe a little bit naïve. We just met those two gents and four weeks later, we finished school and thought we would just use this opportunity and give a 100%".

This self-made video is a document about the work on their first album. The band writes all of the songs themselves and record them in the studio. They go back to David's previous school and use recordings from the school choir for their first single 'Revolution'. The studio is provided by their producers. Here the six work months on end. Time and money is tight. The young musicians reach their limits.

Timo: "I'm pretty shattered at the moment, we just recorded for three days in a row now".

David: "I haven't had a shower for four days. I feel like shit".

They are producing until the early morning hours. They sleep in the studio on the floor. Although their producers already signed a contract with 'Universal' nothing changes about the working conditions for the boys.

Franky: "What we didn't know was that we received some money in advance from Universal. €100.000, and we never saw any of it. They just withheld it".

Timo: "They just took the money and we were still sleeping on the floor there and let us do all the work".

Christian: "They always said, that's pretty natural at the beginning, you just have to eat shit. You have to work your way up, and we didn't have a chance except to just accept it".

And also when it comes to appearances and image, the guys and the producers just can't agree.

Timo: "They just said, yeah it's totally cool if you wear a headscarf , that's totally cool. And we just replied headscarfs? That's totally stupid".

David: "Oh and the best idea was, I was supposed to wear a gown. Yeah totally a joke".

Franky: "They always went to the make up artists and said to them that David and I should wear quite feminine and androgynous make up".

Timo: "The idea behind it was that we don't look like a typical teenie band who just hold their thumbs up like this. And then suddenly you have thousand fans. We wanted it to be about the music. But unfortunately it just backfired".

Even with all those difficulties Nevada Tan started their way to success. The album shoots to number 8 in the charts, the tour is a huge success. But the financial situation doesn't change much for the guys. That's why they approach the media lawyer Dr. Olaf Meinking to check the contracts that they signed with the producers. Obviously it was like that, after they realised that there is success and money to make, they tried to bind them to the contract. You fulfill every position in the music industry, and earn on every income. By selling records, by live appearances, by publishing and author rights and merchandising. After the producers expected to get 40% on the royalties, the situation escalates.

Franky: "They just wanted to get their hands on the rights for the songs which existed for years. They just wanted to get the rights. They just put us under pressure by saying, if you don't give us 40% on the royalties then this or that happens. Then them or they are going to sue us. We just felt, and still feel, blackmailed. And that was the point when we felt, no that's not working".

Now the boys are in a legal action. Because the producers secretly protected the name 'Nevada Tan', the band went back to 'Panik' just like in the old days. To cope with the bad experience they had with the music industry, they put it into a song.

You are nominated for two Echo's, as Nevada Tan or as Panik?

Franky: "Probably as Nevada Tan but we perform as Panik. Well we've completely written off that name."

Guenther Jauch: "Have you told the host of the show, so that he says it right"?

Franky: "No, I assume they find out, we scream it out then".

Guenther Jauch: "One of you was supposed to dye his hair blonde, who would have hit it"?

Franky: "That would've been me then."

Guenther Jauch: "And did you do it"?

Franky: "Yeah after a long back and forth, I did it. And again under pressure, just like "if you don't do it, then you can forget about the whole thing". Well, you just don't let it fail because of that".

Guenther Jauch: "In other words, totally shit then"?!

Franky: "Definitely".

Guenther Jauch: "And how did you get rid of it?"

Franky: "Just dyed it darker straight away".

Guenther Jauch: "Was that some kind of attempt to force you into a Tokio Hotel direction? Just like the motto "Let's clone another successful band"? What was the main reason?"

Linke: "They tried to make it a bit more commercialised than we intended, that just didn't work out."

Guenther Jauch: "Because it was supposed to be better for you, or because of the record company deciding on it?"

Timo: "They never talked it over with us, like "listen you are like this and that's why we turn you into that and then you earn more money", or like that. That was more of a slow process and behind our backs".

Guenther Jauch: "What I don't understand is, the record company didn't seem to completely get what happened to you then. And you didn't really have any contact to them. Why didn't they know anyting about your unhappiness"?

Franky: "All around us was this big bundle of lies. And the problem was that our previous producers, who were our manager at the same time, didn't really allow us to have contact to the record company".

Guenther Jauch: "You were cut off?"

Franky: "Yeah, that's right. And that's why it was so tough. They forwarded messages like it was just said here, like yeah you should wear headbands and the next video is going to be like that and they would really love that. And we didn't know, do they really mean it, is that true? They just said, it's gotta be done".

Timo: " Well when it came to styling we worked behind the managers back and did it like we wanted it in the end".

Guenther Jauch: "Dr. Meinking, as a member of the administration of justice, can't you just say, that's normal behaviour in this business, or is it more of an unusual adhesion contract?"

Dr. Meinking: "Well you experience a lot of strange contracts in the music industry. But there' s a line and this was definitely exceeded. You just have to fotografie it like a screw that you tighten and you keep on tightening it and suddenly this screw gets loose again. And that's just how it was here as well, there were boundaries that just got exceeded. Maybe I can explain it with an example. Concession agreements were made and with those, there were already quite important steps made for incoming money. And at the same time they arranged a management contract, so that both of the producers can act on both sides of the contract. They had the authority to negotiate and also power to contract, they were able to act for the band. And on the other hand they were acting as a record label".

Guenther Jauch: " Normally the manager has to negotiate with the producers about certain things, but they were talking to themselves". (laughter)

Dr. Meinking: "You probably know this from your own experiences, as a trained media soldier, a manager is the sole represantative for the artist against the industry. That's his role, he represents the interests against the industry. The only problem is, when the manager acts as a record producer, a publisher and so on, at the same time, then you have a consolidation of institutional powers."

Guenther Jauch: "Do you know what? That's why I don't have a manager. " (laughs)

Dr. Meinking: "You see, then you're perfectly advised". (laughs)

Guenther Jauch: "Now you've changed your name from Nevada Tan. You're 'Panik' again. Is that very bitter for a band to change your name from a well known successful name just because of juristic nonsense?"

Franky: Well that's why we had to get another one. That's why we thought it would be more honest as a band, if you think of the music, to take on the old name, that you had previously. Back to the roots".

Guenther Jauch: "Well, the name is one issue, but what about if they keep on doing music or want to go on tour, that shouldn't be allowed for them too. Then they would still be under the claws of the old contract. Does that work at the moment? "

Dr. Meinking: "In our opinion the contracts that already have been signed, are in reference to the main contract immoral and therefore void. We think that the boundaries were exceeded, and also what the jurisprudence would allow for these kind of contracts. Who are orientated on a knowledge of the industry sector. Especially because of the already mentioned conflict of interest. But also from a wide area of terms. There was for example a double allowance system. The artists not only received a very small licence, the manager also deducted the management payment from that. There are a couple of other principles, longer terms, no right to say in the matter for the contracts, through which it all results.

Our opinion is, that the band is free. Contractual and in respect to their activity as working artists and in respect to choose a new management."

Timo: " Well, this all sounds quite dry, but we've received a letter where our income was stated and on top of that, what we have to pay the management on top of everything else. "

Linke: "Eventually we received a bill for over 3000 Euros."

David: "Eventually we've made minus 2500 Euros last year."

Guenther Jauch: "We got in atingere with these people but they didn't want a camera interview but declared in writing that actually they are the victims and that you would present yourself extremely ungrateful here. Tell me, now that you've dropped out of school, would you say looking back, that it was a mistake that you shouldn't have done?"

David: "No way." (people are laughing) "Let's say it like this. It is a nice time and it's something that you absolutely need, but for what we are doing now, I am glad that I've done it. "

Guenther Jauch: "What happened to the 100.000 Euros that the management already received?"

Dr. Meinking: "Let's explain it like this. The band had a contract with those two producers. And those producers have licensed them through Universal again. And with this second contract there was an advanced payment of, in our knowledge 100.000 Euros, which still remains with the producers. Which in itself is an unfair fact. Under the artist contract up to now, there wasn't a cent paid out to the band."

Guenther Jauch: "Last question. Stupidly enough you've signed it, everyone was 18 at that time? (they all agree) meaning that you were of age and an adult. What would you advise future 18 year olds, who are put on the spot to sign?"

Timo: "Spend the 500 Euros for a lawyer and then spend another 500 Euros for another lawyer."

Franky: "We are lucky. It still goes on for us. Next week the Echo, new single, new album."

Guenther Jauch: De cand Germania isi cauta Superstarul [Pop Idol] sute de mii de tineri viseaza sa devina cunoscuti prin muzica. Doar cativa chiar reusesc. O trupa ca Tokio Hotel demonstreaza ca poti sa ai succes fiind tanar. Desigur trebuie sa fii extraordinar de norocos sa cunosti persoanele corecte. Dar daca intalnesti persoanele gresite poate fi dramatic, chiar si pentru un newcomer talentat.

Intr-o Sambata, panica in Garmisch Patenkirchen. Panik, acesta este numele trupei de rock care incinge atmosfera la – 5 grade. Au inceput cu dreptul anul trecut, dar sub un alt nume, „Nevada Tan”. De atunci abia exista un numar de Bravo in care sa nu apara. Primul lor single , „Revolution”, a fost lansat in primavara anului 2007. Ei sunt newcomerii anului trecut. Pozitii in top ten, 2 nominalizari la Echo Awards, una din cele mai importante premii din industria muzicala.

Dar dintr-o data totul s-a terminat? Nu mai exista Nevada Tan? Trupa vorbeste despre problemele cu producatorii.

Timo: ei au profitat de pe urma inexperientei noastre. Vroiau sa ne prezinte ca o trupa de casting.

Franky: Muncesti pentru un an intreg si nu primesti niciun ban.

Timo: au incercat sa ne impinga intr-o directie pe care nu o vroiam.

Neumuenster, joia trecuta. Cei sase baieti, cu varste cuprinse intre 19 si 21, se cunosc in unele cazuri inca de la gradinita. Pasiunea pentru muzica este ceea ce i-a unit. In acest garaj transformat in studio si-au facut repetitiile timp de 4 ani. Aici si-au compus întâia lor trupa si obisnuiau sa cante sub numele de ‚Panik’.

Timo: Am avut inițialul spectacol la scoala mea generala, in amfiteatru, la un festival scolar, a fost amuzant.

David: Era un spectacol la care toata omenirea statea jos, camera de filmat era in spatele salii si puteai sa vezi toti acei parinti care se ridica si pleaca intre numere. S-ar putea sa fi fost un pic prea heavy.

Cantau la competitii si festivaluri precum puteti vedea aici in 2004 in „Saga Halle” in Neumuenster. Sau un an mai tarziu in Berlin. In 2006 au fost descoperiti de catre un producer duo.

Timo: Mereu am auzit ca dintr-o data producatorii te apropie si dintr-o data erau acolo, ne-au dus in studio si eram coplesiti.

Franky: Eram coplesiti de tot echipamentul, pentru că dintr-o data tot ce aveai nevoie pentru a produce un album era acolo, toate intrumentele la care ai visat, un imens pupitru de mixaj si in sfarsit totul era acolo pentru a lucra ca profesionisti.

David: Si acesta a fost principalul motic, in excepțional pentru mine si timo, sa terminam cu scoala imediat. Poate un pic naiv. Abia ii intalnisem pe acei 2 domni si 4 saptamani mai tarziu, am terminat scoala si ne-am gandit sa folosim aceasta opirtunitate si sa dam totul, 100%.

Acest self-made video este un document al muncii la primului album. Trupa scrie toate cantecele singuri si le inregistreaza in studio. Se duc la fosta scoala a lui David si folosesc inregistrari cu corul scolii pentru debutantul single Revolution. Studioul este asigura de producatori. Aici cei 6 lucreaza luni intregi. Timpul si bugetul sunt restranse. Tinerii muzicieni isi ating limitele.

Timo: Sunt cam bulversat la momentul actual, am inregistrat trei zile la rand.

David: nu am facut un dus in 4 zile. Ma simt ca naiba.

Produc pana in primele ore ale diminetii. Dorm pe podeaua studioului. Desi producatorii lor au semnat deja un contract cu Universal nimic nu se schimba in ce proveste conditiile de munca pentru baieti.

Franky: Ceea ce noi nu stiam este ca am primit bani in advans de la Universal. 100.000Euro, si noi nu am vazut niciun cent. Ei au pastrat totul

Linke: Intotdeauna au zis ca e normal pentru inceput, ca trebuie sa mancam rahat.Trebuie sa lucrezi pana in ajungi in varf, si nu aveam decat sa acceptam.

In plus cand vine vorba de infatisare, baietii si producatorii nu par sa ajunga la comun acord.

Timo: Spuneau, „da e foarte misto daca porti [ceva gen batic], e super asa”. Si noi spuneam „batic? Ce tampenie.”

David: Oh si cea mai buna idee a fost ca trebuia sa port o manta. Mdea, o gluma.

Franky: Mereu se duceau la make-up-artisti si le spuneau ca david si eu ar trebui sa purtam machiaj androgin, mai feminin.

Timo: Idea din posterior era sa nu aratam ca o trupa de adolescenti care doar tin degetele asa [ :D ]. Si dintr-o data ai sute de fani. Vroiam sa fie despre muzica, din pacate planul nostru a dat rateu.

Chiar si cu aceste greutati Nevada Tan si-a inceput drumul catre succes. Albumul a ajuns la pozitia 8 in topuri, tour’ul a fost un mare succes. Dar situatia financiara nu s-a schimbat prea mult pentru baieti. De aceea l-au abordat pe avocatul Dr. Olaf Meinking ca sa verifice contractul pe care l-au semnat cu producatorii. Evident era asa [??], dupa ce au concretizat ca exista succes si bani care pot fi facuti, au incercat sa incheie contractul. Indeplinesti toate conditiile in industria muzicala, si castigi din venituri, prin vanzarea de albume, prin concerte live, prin publicare si drepturi de autori si marfuri. Dupa ce producatorii se asteapta sa castige 40% din castiguri, situati escaleaza.

Franky: Voriau sa puna mana pe drepturile de autor pentru niste cantece care existau de ani. Vroiau drepturile. Ne-au pus sub apăsare zicand, daca nu ne dati 40% din castiguri, atunci asta sau aia se intampla. Atunci ei sau ei or sa va dea in judecata. Ne simteam, inca ne simtim, santajati. Si acela a fost momentul in care am simtit ca asta nu mai merge.

Acum baietii sunt in toiul actiunilor legale. Deoarece producatorii au rezervat in secret numele de ‚Nevada Tan’, trupa s-a intors la ‚Panik’ ca si in vremurile vechi. Pentru a putea face fata experientei negative pe care au avut-o cu industria muzicala, si-au pus sentimentele intr-un cantec.

hai k acum m-am documentat si eu mai bine despre ce s-a intamplat! nu stiam decat ca au avut pb cu vechii producatori.
shees, ce exploatatori. cum dormeau saracii in studio ca sa inregitreze albumul si nu au primit niciun banutz. apoi ii mai si obligau sa imbrace cum vroiau ei. cik l-au obligat pe Franky sa se vopseasca blond :hmm:

dc omului nu ii place lasa-l in pace. plus cik trebuiau sa para mai feminini cu machiaj, oameni prostii. tot timpul se asigură vb de TH si e clar ca ei nu vroiau sa copieze pe nimeni, dar din cauza producatorilor a inceput totul :rant:

bine ca au scapat de oamenii aia si pana la urma nu conteaza numele ci muzica, ei au ramas la fel!
